1. Overview
DeleteMyTrace ("we," "us," "our") provides privacy exposure scanning, data broker removal facilitation, and ongoing monitoring services through deletemytrace.com, our API, and our MCP server. By accessing or using our services, you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the services.
2. Eligibility
You must be at least 18 years old to create an account or purchase a paid plan. Users under 18 but at least 13 may use the free scan tool only with verifiable consent from a parent or legal guardian. We do not knowingly accept accounts from anyone under 13.
You may only submit scans and removal requests for your own data or data you are legally authorized to manage (for example, a minor in your household through our Family Add-On). Using our services to request removal of another person's data without their authorization is prohibited.
3. Services
Free scan. We check supported data broker sites for your personal information using search engine detection, URL pattern verification, and breach database lookups. Results are provided as evidence-backed findings, not guarantees of completeness.
Paid removal. We submit lawful opt-out and data deletion requests to supported data brokers on your behalf. We facilitate the removal process but cannot guarantee that every broker will comply or that removal will be permanent.
Monitoring. Paid plans include periodic re-scans to detect re-listings and new exposures across supported sources.
API and MCP access. We offer a limited, read-only set of tools through an API and an MCP server. These tools are available at no cost to AI assistants (such as ChatGPT) and direct integrators, subject to fair-use rate limits and the prohibited-uses provisions of these Terms.
4. Honest limitations
We are direct about what we can and cannot do:
- We do not guarantee complete removal of your data from the internet
- Some data brokers may re-list your information after removal
- Some brokers change their opt-out processes without notice
- Public records (court filings, property records) generally remain public
- Our scan covers 15 supported sources, not every site on the internet
- Removal timelines vary by source (typically 2–6 weeks)
5. Your responsibilities
- Provide accurate information for scans and removal requests
- Only request removal of your own data (or data you are authorized to manage)
- Complete any verification steps required by data brokers
- Keep your account credentials secure; notify us promptly of any unauthorized access
- Comply with all applicable laws in your use of the services
6. Acceptable use
You will not:
- Use the services to harass, stalk, dox, or investigate another person
- Attempt to scan or request removals for anyone other than yourself or individuals you are legally authorized to represent
- Reverse-engineer, scrape, or systematically extract data from the services except through our documented API and MCP endpoints
- Exceed documented or reasonable rate limits, or interfere with the availability of the services for other users
- Introduce malicious code, exploit vulnerabilities, or probe for weaknesses without prior written permission
- Use our services to compete with us by building a substantially similar product
- Use our services for any unlawful purpose
We may suspend or terminate access for violations, with or without notice depending on severity.
7. Intellectual property
Our IP. DeleteMyTrace, the DeleteMyTrace name and logo, the site content, the SOP library, the scan algorithms, and the overall service design are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the services for personal or authorized household use during your subscription period.
Your content. You retain ownership of the personal information you submit to the services. You grant us a limited license to process, store, and transmit that information solely to perform the services you request, as described in our Privacy Policy. You will not upload content that infringes the rights of any third party.
Feedback. If you send us suggestions, feature requests, or other feedback, we may use it without restriction and without obligation to you. This does not cover your personal information, which is governed by the Privacy Policy.
8. Billing, renewal, and refunds
Paid subscriptions (Pro plan, Family Add-On) renew automatically at the then-current price at the end of each billing period. You can cancel at any time through your dashboard or by contacting support. Cancellation takes effect at the end of the current billing period; we do not prorate refunds for partial periods.
One-time purchases (such as Priority Removal) are non-refundable once removal work has begun. If you believe you were charged in error, contact support@deletemytrace.com within 30 days and we will review in good faith.
Prices are in US dollars and do not include any applicable taxes. We may change our prices with at least 30 days' advance notice to active subscribers; the new price takes effect at your next renewal.
9. Termination
By you. You may stop using the services at any time. You can cancel a paid subscription from your dashboard; cancellation takes effect at the end of the current billing period.
By us. We may suspend or terminate your account for violation of these Terms, for non-payment, for fraud or abuse, or if required by law. For material violations we will give you notice and a reasonable chance to cure when practicable. On termination, your right to use the services ends and we will delete or anonymize your data per our Privacy Policy retention schedule.
Sections that by their nature should survive termination (IP, disclaimers, limitation of liability, indemnification, governing law, arbitration) survive.
10. Disclaimer of warranties
The services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the services will be uninterrupted, error-free, or that any data broker will remove your information.
11. Limitation of liability
To the maximum extent permitted by law, DeleteMyTrace and its officers, employees, agents, and subprocessors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or relating to the services, even if we have been advised of the possibility of such damages.
Our aggregate liability for any claim arising out of or relating to the services is limited to the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full. Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Indemnification
You agree to defend, indemnify, and hold harmless DeleteMyTrace and its officers, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of (a) your breach of these Terms, (b) your misuse of the services, (c) your violation of any law or the rights of any third party, or (d) any content or data you submit to the services.
13. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
14. Dispute resolution and arbitration
Informal resolution first. Before filing any claim, you agree to contact us at legal@deletemytrace.com and give us 60 days to resolve the dispute in good faith.
Binding arbitration. If we cannot resolve a dispute informally, you and DeleteMyTrace agree to resolve any claim through binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, seated in San Francisco, California, and conducted in English. Judgment on the award may be entered in any court of competent jurisdiction.
Class action waiver. Claims must be brought individually. You and we each waive any right to participate in a class, collective, or representative action.
Exceptions. Either party may bring (a) an individual claim in small-claims court if it qualifies, or (b) an action seeking injunctive relief to protect intellectual property rights, in a court located in San Francisco County, California.
Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@deletemytrace.com with the subject "Arbitration Opt-Out" and your account email. Opting out does not affect any other provision of these Terms.
15. Changes to these Terms
We may update these Terms as the service evolves. Material changes will be announced via email to registered users and via a notice on this page at least 30 days before taking effect. Continued use after the effective date constitutes acceptance. If you do not accept a material change, your remedy is to stop using the services and, if applicable, cancel your subscription.
16. Miscellaneous
Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us regarding the services and supersede any prior agreements.
Severability. If any provision is held unenforceable, the remaining provisions remain in full effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
No waiver. Our failure to enforce any right is not a waiver of that right.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets, with notice to you.
Force majeure. Neither party is liable for delays or failures caused by events beyond reasonable control, including natural disasters, internet outages, data-broker policy changes, and acts of government.
